Terms of Service

1. Acceptance of Terms

By creating an account or using SMSLite in any way, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including trial users, paying customers, and API users.

2. Your Account

You must be at least 18 years of age and a registered business or individual operating in accordance with South African law to use SMSLite. You are responsible for:

• Maintaining the security of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately if you suspect unauthorised access.
• Keeping your contact and billing information accurate and up to date.

3. Credits and Payment

SMSLite operates on a pre-paid credit system. Credits are purchased in advance and deducted per SMS sent. The current rate is R0.50 per SMS unless otherwise agreed in writing.

• Credits are non-refundable once purchased, except where required by law.
• Credits do not expire while your account remains active.
• If your account is suspended or terminated due to a violation, unused credits are forfeited.
• All prices are inclusive of VAT where applicable.

4. Acceptable Use

You may use SMSLite only for lawful purposes and in accordance with these Terms. Acceptable uses include:

• Marketing and promotional messages to opted-in recipients.
• Transactional notifications (order confirmations, appointment reminders, OTPs).
• Internal business communications.
• Customer service notifications.

5. Prohibited Use

You must not use SMSLite to send:

• Unsolicited commercial messages (spam) to recipients who have not opted in.
• Phishing, fraudulent, or deceptive messages of any kind.
• Messages containing illegal content, hate speech, or material that promotes violence.
• Messages impersonating another company, person, or brand.
• Messages to numbers obtained without consent or from purchased lists.
• Content that violates POPIA or any other applicable law.

6. Intellectual Property

All software, designs, trademarks, and content on the SMSLite platform are owned by SMSLite (Pty) Ltd. You are granted a limited, non-exclusive licence to use the platform for its intended purpose. You may not reverse engineer, copy, or resell any part of the platform.

7. Service Availability

We target 99.8% platform uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where possible. We are not liable for delivery failures caused by mobile network outages, SMSC issues, or force majeure events.

8. Termination

You may close your account at any time by contacting support. We reserve the right to suspend or terminate accounts that violate these Terms, without notice or refund of unused credits.

9. Limitation of Liability

SMSLite's liability to you for any claim shall not exceed the total credits purchased in the three (3) months preceding the claim. We are not liable for indirect, consequential, or punitive damages under any circumstances.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved in the courts of South Africa.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance. We will notify active users of material changes by email at least 14 days in advance.
